Chinese lawmakers discuss supreme court report

Panel meetings have been held during the 11th Session of the Standing Committee of the National People's Congress. They have discussed reports submitted by the Supreme People's Court and the Supreme People's Procuratorate, putting their focus on how to improve the execution of court rulings.

The Standing committee members commended the Supreme court's report for not hiding its drawbacks of insufficient execution.

The court report says only 44 percent of those accused in property disputes would voluntarily implement the courts' ruling. This leads to a huge amount of extra work for staff.

Chen Sixi, member of NPC Standing Committee, said, "The issue attributes to the disfigurement of property monitoring system. In addition, a system for individual bankruptcy is also needed, otherwise the acused may be much easier to hide his or her property to avoid punishment."

Some lawmakers suggested there should be a separate institution for execution, instead of an execution division under the court.

They stressed that execution following the court ruling should be an administrative action, and the courts' authority might be damaged if the court spends too much effort to implement its decision.

Cong Bin, member of NPC Standing Committee, said, "If a judge has to consider how difficult it is to implement his or her decision, then the judge's sense of justice may be influenced. This would obviously be harmful for people involved in the case."

The standing committee members also commented on the low penalty for tort liability, one of the major topics in the Procuratorate's report.
